It is EWANID Service Centers policy not to construct wills and living trusts. This is based on recent guidelines from the National
Notary Association on the potential liability a non-attorney Notary faces if notarizing a self-constructed will. The will itself may
even be rendered invalid. Living wills and trusts have some similar liability aspects to wills. Wills and living trusts are potentially
complex legal documents and we recommend that they are constructed by an attorney. This also includes codecils to wills.
However,
EWANID Service Centers is happy to assist with the following:
- Notarizing a will or living will or trust prepared
by an attorney
- Notarizing a will or living will or trust obtained online from a website providing documents approved by US licensed
attorneys e.g. Legalzoom.com
- Notarizing codecils to wills from either of the above sources
- Certifying a copy of a will or living will
or trust
- Certifying the identity of a witness to a will or living will or trust
"Living Wills" are also known as Health Care
Directives.
Important Note:
We will only notarize attorney prepared wills, codecils or living wills or trusts that
have the correct notary wording pre-printed by the attorney. Notary wording varies according to State and you should check with
us first that the correct wording has been printed to avoid disappointment. This is especially the case if the document was constructed
outside the State of Washington.
